My husband only owes about 2200 dollars to his ex for child support and if we file married but separte will I still get earned income credit for my three kids and if so will she get more money too. If you filed seperataly and you declared your 3 kids then you should get the refund (the child tax credit) not him.
Also you should file first thing tomorrow morning,go to HR block (or other tax service) as fast as you can.

When you and your husband files your taxes, make sure you file an %26quot;Injured party form%26quot; this way they will not take the whole refund, but just part of it, and it will come in your name only, b/c it%26#039;s not your debt.
But to do this you have to file Married, and still get your EIC for your 2 kids, (not 3, the max is two) You also get your ATM for your school expenses, child care, extra child care credit.

If you file a joint return and he owes back child support, the ex will get it. Filing separately will help you to avoid this, but you won%26#039;t get the married/filing jointly tax break. But I would rather get a little bit of something than all of nothing.

If you guys file separately they won%26#039;t take your money away from you, it is his debt not yours. If I were you I%26#039;d file separate, but would only claim 2 of my kids (since you will only get EIC for 2 kids), and let your husband claim the other child, that way he gets a little higher return and yes she will get it, but look at it this way the faster he gets caught up the faster you don%26#039;t have to worry about doing your takes separate. As frustrating as it may seem to you, it doesn%26#039;t matter how or why she got pregnant, the fact of the matter is she didn%26#039;t do it alone and now your husband (and indirectly you) has to take care of his responsibility.
