What's my filing status????

I married last year at the end of August, but if I file jointly with my husband, the government will garnish everything due to his student loans, and there goes my earned income and child tax credits!!! What do I do? Are there any loop-holes?

Bostonianinmo is correct. Your only options for filing are married joing or married separate - married separate disqualifies you for the credits and their are no loopholes to get around this. The form 8379 is an %26quot;Injured Spouse Claim%26quot; and it will get you the portion of refund that would be yours separate from your husbands.

File a joint return. Attach a Form 8379 to protect your share of the refund.

you can file married but filing seperate....i would ask whoever is doing your taxes which way would be the best....i know that for child support garnishment, they won%26#039;t take the other person%26#039;s refund, they only take the one that owes, so maybe it%26#039;s the same for loans

You can file a joint return and file an injured spouse form. The refund will be split based on the amount due to each person%26#039;s income and withholding, and only his part will be taken.
